If this person wins their case, that means that source code is
speech, and thus protected, and thus encryption export controls
are illegal.
It's probably not that simple. A successful suit might not touch on
first amendment issues in any substantive manner. Other successful
suits have been based on speech and displays in the workplace that
would have been protected in other contexts.
