XEmacs is GPLd, richard's problem is that the FSF does not own the
copyright, so would not be able to defend a combined work in court. For
some code in XEmacs, the author is either unknown, or they are (or their
employer is) unwilling to assign copyright to the FSF,
This is a very good argument against having XEmacs simply 'supplant' Emacs
as 'the' implementation. But I think richard could use a lot more code
than he does. It just isn't worth the trouble arguing about it anymore. :)
