Section 2 of the GPL states that if you modify a GPL'd program the result, if distributed, must be distributed under the terms of GPL. If the GPL is a valid license then this is all the protection we need in order to continue to use and modify and distribute XEmacs. I am not a lawyer, so I'll leave more "creative" interpretations of the GPL to them.
