Now that's interesting. Neither texinfo 5.1 nor 5.2 catches this
error, but texinfo 4.13a does. I will push a fix for the problem
shortly. However, you will just hit another error: texinfo 4.13a
cannot build the texinfo 5.2 info files.
I don't know why we ship texinfo info files anyway. I don't know what
other distributions do, but in Fedora, we deliberately throw away the
XEmacs copies of these files, because they conflict with the ones
installed by the texinfo package itself. Why are we distributing some
other project's info files? Can we stop doing that?
I think we *must* stop doing that, given the incompatibilities between
4.x and 5.x. I'll submit a patch.

seems to be more or less a copy of the version in the distribution up

Originally we did it because XEmacs predates distributions. If we
didn't distribute, users would likely not have a copy, and TexInfo is
an essential part of XEmacs documentation.

Nowadays? Sure. I may move a copy into general-docs or something
like that for historical reasons and to serve the occasional user on
systems where you wouldn't expect TexInfo to be installed (Windows,
especially natively-compiled XEmacs users), but no need to wait for
that.
If I were doing it, I would wait for Vin or Adrian to sign off,
because of the Windows users. But I expect they'll be OK with it, so
no need to wait more than a week or two. Mac OS X is not a problem,
at least up to Snow Leopard it comes with the TexInfo distribution.

From the point of view of the 21.4 maintainer, I don't mind
removing
the texinfo.texi file.
I don't know how that would affect the Windows installation kit (and I
don't have an easy way to test that at the moment), but I think I'm
still OK with the change.
From the big picture, though, we do not have an acceptable makeinfo
solution. I have used 4.13a forever and it still builds the 21.4 info
files, but 21.5 requires some flavor of texinfo 5. I find that
dichotomy acceptable, mostly because the rate of change in the 21.4
branch is, at fastest, glacial, and I am probably willing to fix
21.4's .texi files so they work with texinfo 5+.
What is worse, IMO, is that the packages will not build with texinfo
5. I am currently using texinfo 4.13a to build the package info
files, and this is somewhat annoying, having to dance back and forth
between texinfo versions. If nobody beats me to it, I will probably
try to fix the packages' texi files so that they build with texinfo 5.
