Its against the original file, which came with XEmacs.
BTW have a look at the head of the diff, see the timestamp.

Linux/Unix command `patch' should work against the already
patched
footnote.el too.
That was not entirely clear to me, I thought patch might simply
refuse
to apply a patch when file to be patched is not the correct one.

Oops I thought supercite (sc) is the style which allows you to adjust
the quoting like it does in this message.
