In any case, I think that a lawsuit by FSF against Microsoft would be a joke because I'm cynical enough to think that money and power are bigger factors in determining outcome than being in the right. Similarly, I think that marketing is a bigger factor than quality in determining commercial success -- as far as I can tell, that's the only possible explanation for Microsoft's so-called operating systems having any signficant user base.
