Well, of course we can't assure the existence of a sufficiently recent
makeinfo. What do you propose we do if we find the supplied makeinfo
is too old? Just ignore the rule?
Post an explanation that makeinfo is too old to compile some of the info
files and that it needs to be upgraded? If this problem is like another
related to very old GNU tools with new versions under GPL 3, new versions
of OS X may not upgrade to the newer versions of the GNU tools. At
present, the problem appears to affect only texinfo.texi
