In the U.S., there are no excuses -- if you can't read the license,
it's your problem. Yes, they can get possibly avoid statutory damages
and/or criminal charges that way (because to some extent they depend
on intent), but the FSF (and maybe Sun) is the only party in a
position to enforce either of those IIUC -- nobody else has registered
copyright in XEmacs AFAIK (Lucid's were all assigned to the FSF
according to Jamie Z).
