There was a long thread on this exact subject, and the upshot was GNU
Emacs already requires Texinfo 4.2, so live with it until your distro
catches up, or build Texinfo 4.2 yourself.
If you're updating by CVS, just remove it yourself. It'll stay
removed (unless Kai does a major reorganization of the texi source,
but that will cause a CVS conflict), and as long as you don't
redistribute, there's no legal issue.
Or switch to Debian.
